But you get scammed every day....



Went to the diner last night, The menu said appetizer special, 4 hot wings, 4 mozzarella sticks and curly fries.. You are brought 2 huge bowls of marinara and blue cheese, and a plate containing 4 wings, a bunch of fries and 3 mozz sticks buried underneath the fries, so unless you count before you eat, they just scammed you out of a moz stick. And with 4 people eating, no one keeps count... I caught it an made them bring the other stick, but they tried to get away with it.. This was just a small size scam..

Nice easy scam. Not surprised. E-Bay in my opinion has really gotten bad since the first time I used it. Used to be you buy something and feedback was left from the seller at that point. The item was shipped imediately after they recieved payment and you got it after it's trec from wherever and then you left feedback. Now it take a chance, roll the dice and hope you get it at all. Alot of people on there are selling stuff that they don't even have! I just waited three weeks for a set of DVD's that I ordered from a company that said they had 13 of them in stock. Turns out that he didn't have them "on hand" and had to order them from somewhere. They then sent him a DVD of one and a VHS of the other. So he then had to reorder them and he had them sent straight from there to me. I got them in the mail today so I am breathing a sigh of relief. And to beat all, they were for a co-worker of mine who wanted them for her kid. Probably the last time I do that.;)
 
I'm not so sure anyone can get away with the scam as outlined in the website above, at least not if you get shipping insurance.



IF you have insured the package, than you should make a claim against the carrier saying package contents were tampered with during shipping. I assume you wouldn't be lying because as the scam reads the seller will attempt to claim they sent the right product. So, just file a claim with the carrier, indicating a problem description like:



"items tampered with; removed and replaced with miscellaneous unwanted items of same weight presumably during transit; see shipper for details."



Then, as the buyer, the issue is totally between the seller who packed and shipped and the carrier. They can they duke it out as to what got shipped, by whom, when.



If you take that recourse, the seller probably will cave and refund your money lest they incurr the wrath of a carrier, who might blacklist them, and have a whole set of real sticky laws to slap them with.

I sell items on ebay, things around the home that get's me extra money for other wanted items. I take pride in giving the best service possible, fast shipping and immediate feedback after payment is received.



What I hate is the sellers that won't leave me feedback even after I pay immediately and leave them feedback once item is received. I make sure to let them know that they have lost a customer and I follow up on my feedback left stating that the seller doesn't acknowledge feedback.



 
Yes the old "Hide the Mozzarella sticks under the curly fries" scam. I'm suprised that people still fall for that old trick! :rolleyes:

Even if you file the claim with the shipper, the seller can just deny that the wrong item was ever sent... no matter what its the sellers word against the buyers word....



Even if you get reimbursement from the shipping company, and the seller doesnt cave in, which I dont see why he would, since there could be no proof he didnt send the correct item, the seller would still make his money, and you'd get yorus back...



Its a pretty safe, secure scam from what I can tell...



 
Actually, I got scammed in a similar fashion but you don't have to wait for the first complaint. The seller can ship junk or anything to the buyer and as long as the sell has proof that the items was shipped, PayPal is not responsible for the condition or authenticity of the item shipped.



A few years a go I bought a digital video camcorder that was supposed to be brand new, but the box had been opened. When I received the item it was immediatly appearant that there were parts missing and the camera was damaged. It appeared that someone had tried to pry a tape out of the transport mechanism with a screwdriver or something. I contacked the seller and she said she would send me another one, but I never heard from her again. When I contacted PayPal and filed a report, the stated that I had received the package and therefor there was no further action that the could take since they are not responsible for the contents or condition of the merchandise.

Right. If you have insurance, the seller swears he sent you "A", you swear you received "B", then it seems to me the carrier is caught in the middle and has to refund. I haven't actually experienced that, but I don't see how it is different than a package that arrives broken or with missing pieces because it is opened in transit. So, as you say, CK, the seller keeps his money, you get yours back, and the carrier takes one on the chin. The carrier won't take too many on the chin from that seller or to that buyer before SOME red flag is raised.



Again, I am assuming, because I would never try to perpetrate mail fraud, nor have I been a victim of it...intentionally packing and sending the wrong items is mail fraud, IMHO.

Sometimes honest mistakes do happen. I once bought a fairly expensive digital camera on Ebay. When the package arrived, it was a cordless phone. I immediately contacted the seller. He said the items he sold were already packaged a head of time and he just put the shipping address on the wrong package. He was right. I received the camera in a couple of days. On top of that, he said don't bother returning the phone, just keep it. A rather nice experience I must say, and an honest mistake corrected.

It just amazed me how it can be so easy... how can they even justify its safe when all it takes is an incorrect package.



What if 1/4 of the people on ebay did this... this is millions if not billions of dollars.



I think the idea of waiting till the claim is filed is to stop PayPal from persuing action....



 
I buy and sell on Ebay all the time. Only got screwed once and luckily it wasn't for much. It's not perfect but I sure have made some great deals and I'm not going to give it up. All you can do is be real careful.

I am in the process so I cannot tell how well the it works but at least the threat of the FBI breathing down their back for a couple hundred bucks (or less) could be a deterrent.
