Hey.. new member... Anyways, just figgured I'd sign up just to post this:



So the other day I got hit. A 60yo lady driving a Dodge minivan sideswiped me from the right lane. She just came over into my lane and rammed my truck. There is a pear shaped/sized dent in the front right quarter panel, hood scratched, bumper cover scraped, light scrapped, and the fender panel is misaligned. The impact pushed my truck over into on coming traffic. Luckily there wasn't anyone coming from the other direction or I'd be posting this from beyond! We were going about 40mph.





10yo truck, no scratches (ok, one little one) looking awesome and new then this **** happens. The lady that was driving was working and driving for a company that takes care of mentally and physically handicapped people. She was DRIVING them to another location when she did this. This lady is a menace! I wish I could post the name but I'd probably get in trouble :) I'd seriously be pissed if there were my family members in her car when she was driving like this. She even avoided stopping. I had to chase her down and make a very illegal turn (she did too).



Cops said he couldn't figure out fault, so no tickets. But insurances both agreed 100% HER fault. Estimated damages is $1500. But that's just for the paint and dent removal, have not been to the repair place yet.



No real injuries really, except for mental PTSD stuff. And the lady is flat broke and the insurance company is a POS so not worth persuing lawsuit (at this time). Oh, my mom was with me right on the passenger side.



I really want to post her name and the company's name so nobody uses them for the care of their family. Of course, my family has been notified never to use them.



 
Regardless of how broke she is, her insurance liability coverage should cover fixing you car without you having to sue her. Even if she had a ton of cash, what would be your basis for a lawsuit? Were you or your Mom injured? Did you suffer losses other than the damaged bodywork?



Being a reckless, inattentive, dangerous ******* is not good, but it's not actionable.
 
Yep, Her insurance company is on the hook to make repairs to your truck. Take your truck to a body shop for the repairs and give them the estimate from the insurance company. Let them deal with her insurance company if they claim their is more damage or additional costs above the insurance estimate.
