ok i have drawn to the best of my abilities (i swear im not retarded) exactly what happened to give everyone a visual..please keep the help comming the first post was awesome and i will deffinatly remember all the help for you guys..

to clear everyones questions...

1- it is a high school

2-one way lane

3-kids were entering from only one side, the side i wasnt on

4-the bus driver took my plate wrote it on some ticket and said i would get a ticket in the mail tomarrow

5-it happened exactly as the bell rang for dismissal...i have senior privlages to leave early so i wasnt skipping..lol

If the drawing is close to what happened, you never passed the school bus, and even if a student had crossed in front of the bus, you would not hit him or endangered them. In Texas, you can stop along side the school bus but you cannot pass it when the lights are flashing and they are loading and unloading students.



Like I said earlier, I doubt that he will do anything, but if he did I doubt that you would get a ticket in the mail since it was not actually witnessed by a police officer, and the fact that you did not actually pass the bus.

Judging from your first post, I think the bus driver turned his lights on just as you were going past the end of the bus. You also never passed the bus. Be calm and firm in your position that the lights were not activated before you started past the bus and that you were not looking towards it as you maneuvered into the parking space on the left.



One question, does the bus have mechanical stop signs that unfold from the side of the bus?

Again, Like I said in your original post, I can't see a ticket showig up in your mailbox over this.I would really be shocked if you did. And if by the remote chance you do, follow this guy with a camera, he's bound to screw up somewhere. Please keep us updated.
 
First off the bus driver can not issue a ticket. He can put in a complaint to the police department stating his observation of your alleged vehicle violation. See the incident was not witnessed by anyone other than the driver, the police can not legitimately issue you a ticket. If the driver presses the issued and makes a formal complaint he is open to liable if he can not prove his accusation. If it were not this way then the bus driver would be above the law and could have a ticket issued to anyone that he could read the license plate off of. That's my take on it.
 
Another thing I would do is have you and your friends file a formal complaint against the driver with your school system. Report that he was negligent in his lights and he wrongfully accused you are breaking the law. He also thretened you that you are getting a ticket in the mail.



BTW, we know how fast the "justice system" works. the we got the USPS. Thay have a hard time delivering the mail within a week. how will the Police print the ticket the following day, drop it in the mail and you get it the same day. Get real!!!

Like everyone has been saying IF you get the ticket take it to court and bring this, or a better drawing with you. Also, if you have no driving infractions, never been ticketed before, it might be worth it to get a copy of your driving record also, to present as evidence.



And like I said before, you technically didn't "drive through his lights." And no one was endanger because no one was loading yet, correct?

My wife teaches elementary school. They have a simular setup with the bus drop off and pickup. It is perfectly legal for parents with cars to drive in and out, to the left of the busses. There is sometimes a constable there directing traffic. He never tickets anyone. I think you caught the buss driver, trying to be an Ah***e..;)

How does your mind work? How do you take a minor traffic dispute and make it into a federal case against the US Post office for poor delivery service??? :wacko:

In some states a bus driver can get the information needed to give to law enforcement officers to issue a citation based on the information provided. The driver would need more info than just a plate number though; like make, model, color of vehicle and possibly a vague driver description, basically race and hair color, style.



As for liable, that's a stretch because he's not causing his character to be defemated. If an officer issues me a citation for running a stop sign it has nothing to do with my character. Plus, tickets are not made public. Meaning the general public does not know I got a ticket for running a stop sign if that were the case.

Parking lots are a tricky subject. If you are reckless and flying through the parking lot, cutting through parking spaces at a high rate of speed, you could be hit with reckless endangerment and speeding, if there are speed limits posted in the particular parking lot. You are not obligated to stop at stop signs in a parking lot you could roll through if there was no other driver or pedestrian there. The only basic rule for a parking lot is Yield.

Try actually reading my post. What I said, and I will double space everything since you must have a reading problem, which I feel sorry for you. I will also enter comments in <I>Italics</I> so you have a better understanding what I ment. I will also explain what the comment ment.

mike--I'm not sure it matters to the discussion, but just in case it does--what is the green object on your drawing? I'm assuming the yellow is the bus.
 
Is the parking lot on school property? Is the school bus driver a school employee (most are contracted services)? If the bus driver is an employee, is his complaint supported by the school board?



Seems only the SCHOOL could file a complaint against you, and not a bus driver. It would still be your word against his.



I vote to find the bus driver somewhere alone and beat the crap out of him. He sounds like a real a__hole and someone who is trying to push his weight around. This issue does not sound like one of child safety, but rather of someone being a butthead. If you had hurt someone or damaged property, etc. than I would feel differently.



I don't think the bus driver has a leg to stand on here, and I don't think you have anything to worry about.
 
thanks guys...more good info. the green square is just a lawn space.

no ticket in the mail today so that was cool. still keeping my fingers crossed.

on a good note at least my incident will educate everyone on school bus laws!!!:lol:
