I thought of that, but pick your battles. I can easily say I want their fence off mine without looking like an ass, the next part not so much. I do plan on resealing the post after they take it off.



Now if they give me **** about it, then they might start hearing from other people on the issue.

Assuming your section of fence isn't a "propery-line" fence, I would recommend you:



- Give them a bill for 1/2 of the shared segment of fence;



- along with a document from a lawyer indicating that they have placed their fence on your property and that by you allowing this to happen you in no way are giving them any ownership rights to your property, either stated or implied; furthermore the document should state that they are resonsible for the maintenance of their side of the fence; ask them to sign the document.



If they are unwilling to pay or sign, ask them to move their fence.



You might consider this approach, and as I think about it, it is very fair.



Another approach is to TALK to them about the very same thing. Ask them to pay for 1/2 of the fence and maintain it. If they ask "WHY", then calmly explain that you can't maintain the fence now since you can't get to it, and they are clearly using 1/2 of it...



(or do I misunderstand the issue, are they only using ONE corner?)

Technically they are using half of it, they just attached theirs to one of my poles. I would have had the fence no matter what, so I won't ask for them to pay for half of it. I doubt they could come up with the cash to pay for half of it anyway, fences aren't cheap around here. The issue isn't getting use out of the fence, it is that they would attach something of theirs to something of mine without even asking. I can relate it to me going out and putting attachments on their house for my clothes line without asking, the same priciple applies.
 
Again, R1ch99999, you failed to mention if this fence is on or significantly near the property line, and what your township ordinances are regarding property line fences.



It just MIGHT be the case that the side of the fence facing them *IS* theirs to do with as they please and that your sense of "intrusion" and "violation" is misplaced.

It is close to the property line, I doubt that my town says the other side is theirs, especially since when I had it installed I had to have the permission of my neighbors to put a pole next to theirs.

Do you think you should check with the township first and then know for sure? The fact that you had to seek the neighbors permission means to me that your township recognizes the neighbors rights in this situation, and who knows what rights are implied.



Township ordinances vary from township to township, and homeowner associations only add to the issue. In my neighborhood privacy fences are prohibited.

Here in Texas the property boundry lines cannot be changed or altered because someone put their fence on the neighbors property. The neigbor who's land has been encroached upon, does not have to say anything. Any portion of the fence that was erected on the other property is considered illegal and abandoned property. The owner of the property can ask the person to remove the fence from his property or remove the fences and sue the neighbor for the cost of removal, but unfortunately you are stjill getting involved in a feud with your neighbor.



I would personally let it go for a while and get to know the neighbor. Assuming he is a friendly guy and you are friendly towards him you will probably get along very well and then you could mention that you are a bit concerned about his fence being attached yours or being on your property, etc. You may find that he did not know it offended you or how the laws regarding fences are interpreted in your area. This is particularly true if they are erecting the fence themselves. If they hire a fence company, they will usually explain the local laws and that will usually eliminate any conflicts with the neighbors.

If my "neighbor" destroyed my property by being so ignorant not to ask for permission, then I would do the same.



They think he's a pushover...Thats the problem with people and thats why they think they can do what they do... no one wants to confront people about things. Everyone doesn't wont to "disturb the peace."



If I work my butt off for a nice fence and someone comes along and drills wholes in it.. I would be irate!:angry:

 
when i put you my fence 7 years ago it was my wife my sister and me putting up 300 feet of fence one neighbor came out and asked if we needed a hand so i said yes he proceded to clap his hands and went in side:angry:,so i switched which nails i was shooting 125' of fence with 1/2 inch of nail sticking out the other side.oops.:eek: now after Katrina i put up a new fence not one offer to help from either neighbor but no coments this time:lol:
