What kind of car was she driving? I'll bet it wasn't a good 'ol red-blooded American car made by UAW labor! What a bi**h! She is supporting Al Quaida and Communists!

Q, not all sidewalks belong to the city--some are private. The one leading from our driveway to the front door of our house, for example, is all ours. :D

Q,

Wow...name calling (bonehead, smartass).

Did you get written a citation, Q? Of course you did! Then I guess traffic citations CAN be written on private property!

But I understand your point, you feel that police have no jurisdiction to write such citations, so I suggest you please tell it to the judge and let us know how you make out. Report back and I will be the first one to be "educated" and admit it *if* your case gets dismissed due to lack of jurisdiction. Until then, we can wait and see....and please try to be civil.

BTW, I was joking when I wrote what I did. Can't take a little humor, huh?

Our street is a private road and the sidewalk and streets are maintained by the Homeowners association not the city. The only thing the city is reponsible for is the sewage at the street but not to the houses. We even hire a street sweeper every three months to clean our streets.

The Police have no problem of writing tickets for cars that park in front of the fire hydrants on our private streets.

The police don't patrol our neighborhood our neighborhood watch program does.

Gavin - she was driving a Ford Contour.

Sorry Q, I forgot that you said the citation he gave was a written warning only not something you could plead innocent to.

However, my point still remains because as you said, he had no jurisdiction. If you are so hell bent on getting satisfaction, why not go to the town's JP or magistrate, or whomever his superior is with the citation and lodge a formal complaint. Right is right, and if the policeman had no jurisdiction to write a ticket, then he has no jurisdiction to write a citation of warning....right? Let us know how you make with on that.

Might be more useful than complaining about it here. Then you are less of a victim and might actually get that policeman to change his ways, assuming he did something wrong.

Also, the “stab” about ignorance and not showing people the respect they need and not being able to read and comprehend...give it a break please. I don't need a lesson in RESPECT on this board from you of all people, nor do I want to "whip out" our IQs for a pi$$ing contest as I have nothing to prove, nor do feel so insecure as to need to prove anything.

Like I said, want to educate me, then use the correct channels to lodge a complaint and see where that goes and report back!

Sorry, what does that mean...that you won't stand up for yourself, lodge a complaint against the officer and report back the results?

Why not?

Technically speaking it would be mercy that she would receive from you, not grace. Grace is a gift not earned. Mercy is not receiving what is deserved.

True, Teasip, that is one definition of Grace. So is the following from Webster's Dict:
disposition to or an act or instance of kindness, courtesy, or clemency

And, clemency means per Webster's:
disposition to be merciful and especially to moderate the severity of punishment due

So, I guess we are both right. Grace is a very misunderstood word with many meanings that are subtly different.

I prefer Kumbya. But I must admit that watching Ray Charles sway in the front row does choke me up everytime!

Just find it ironic that this same site has us in vigalante fashion wanting to beat down a lady that does no damage when bumping a car in one thread, while bitching about police that give a citation for someone going off-road on private property in another. So which is it folks, we care about protecting personal property or we don't?

(sorry to hijack the thread SST...and as I said, you handled it well).

SST, you never did mention--was there any damage from her hitting/bumping your car? I assume not, as you likely would have mentioned it if there were. If there was, then yes, just for the sake of getting everything properly handled through insurance, it likely would have been worth filing a police report. If not, then yes, I think you handled it well--although in addition to what you told her, it might have been worthwhile to remind her that in today's world with eyes and cameras witnessing everything, lying in that situation really can end up backfiring, as it was happening there with you catching her in the lie.

Either way, I'd have at least taken down her license plate number, in case you later find damage you didn't see at first.

Bill V what would then keep the lady from saying she didn't do said damage, or even saying she was never at the scene?

Seems to me if you think there might be damage, then you have to call the police. If you are SURE there is no damage, go your seperate ways. If later you find out there was damage, well then tough luck...that's what being SURE means.

Does anyone have experience with trying to collect on damage done without an accident report and when the other party tried to deny things?

No damage and the car is so old I wouldn't be able to tell if there was...LOL It's a 91 Corrolla with a much needed wax job. It's my 16 year old step daughters car. Lucky she wasn't home she would of pulled a teenage freak moment.
