I auctioned off the carputer I listed in the Swap and Sell on eBay. It sold for $212.50...not bad...it's worth a lot more.

Anyway, the auction closed on June 26th. I sent an invoice immediately and waited three full days (27th, 28th, through EOD 29th) for a response and/or payment via paypal from the buyer.

The buyer didn't respond, so on June 29th I sent a reminder about the invoice and thanked him for bidding and winning. He responded on the 29th and he said:

"I got the invoice and plan to pay 'after July 4th'...'"

I responded and thanked him for the communication, and in doing so, said that I was now expecting payment by July 5th and would relist on the 6th if I didn't get it (may have been too heavy handed). I did this simply to force the communication of an exact payment date.

Maybe I shouldn't have done that because he kinda freaked and said in another response:

"Are you kidding? I get paid on Friday, July 6th at 4pm and will pay you after that if that is okay"

That was July 30th. That was his last message to me.

I responded and said that payment on the 6th would be fine.

I sent a reminder over the weekend asking him to let me know when I should expect payment and more or less pleaded for communication.

Nothing so far.

At EOD tomorrow it will be 14 days since the close of the auction and it will be 10 days since his last communication (assuming he doesn't reach out between now and then).

My question: Should I wait longer after EOD tomorrow, or do I just neg him and relist or give a 2nd chance offer?

Thanks,

TJR

If you feel that the sale price was more than fair and that you probably could sell it again, I would give him a negative feedback and relist. I would communicate that to him and E-Bay complaint Dept. as well. Good luck on your problem. MikeC

Neg feedback and re-list. You can contact eBay and they will credit your account so you're not charged the selling fee for a non-paying bidder.

Report him as an unpaid bidder. Let ebay give him a strike, get your listing and closing fee refunded and put it back up for auction.

One more follow up notification indicating that you are still awaiting payment and that you have been patient. Explain that if payment has not been received by 10 July before midnight you will be forced to relist and report him as a non paying bidder. If you hear nothing or don't receive payment by midnight tomorrow night, initiate the claim so you can get seller fees cleared. That's what I would do.

I only give auction winners 5 days to pay, and then only through PayPal. My auctions say that if payment is not received within 5 days, the item will be re-listed and negative feedback will be left.

If you do not hear from him by EOB today, relist it and hit him with negative feedback. You have given this person more than ample time to communicate and pay. When he gets paid is irrelevant to you...he should have thought about that before he bid on and won your item.

TJR did your auction state you wanted immediate payment from the buyer upon closing of the auction? If not, then ebay gives a buyer more then 3 days to pay for an item.

Find out what the maximum days ebay allows and go from there. You can either start a conflict resolve with him through ebay, or just give him negative feedback and relist....

whatever you do, read ebay's rules first so he doesnt flip this thing around on you.....

I agree, relist and give him negative. I thought about making a bid on it... Still might

Fmarano, I didn't specify in the auction when payment was due. I don't know if ebay defines a maximum payment term. I always assumed payment within 3 to 5 days; 7 days max...two weeks is too long.

I will check eBay and get back to you all...I did a cursory check and found nothing.

Update: EBay says a non-payment dispute can be opened 7 days after auction close. I opened one.

SST...if he doesn't come through you have a deal.

When I did sell on eBay, no longer do, I gave them 5 business days. I felt that was plenty since when I bid on items I expect to pay them the same day or the next day when I win the item.

I agree. I don't bid unless I'm prepared to pay immediately. The longest I've gone without paying is if the austion ends while I'm sleeping, and I pay in the morning.

Fry him.

In the past, there have been times where I've bid on items that, if I won, I wouldn't be able to pay for a while--once was as long as three weeks. But in every instance, I always contacted the seller before bidding, asking if that was acceptable, and then only bid if they indicated they were OK with that.

In this case, I'm in agreement with C--it's only been one business day since the most recent 7/6/07 deadline. Give one more notice, give him another day or two--and if nothing happens, report him and relist.

Waiting to get paid to pay for an ebay item is a cop out. They could use a credit card through paypal and they would not be billed for a month anyway. Like everyone else said: leave a negative feedback.

There have been times when awaiting Paypal deposit to clear that it took me 3 or 4 days to pay, but I always communicated with the seller and gave them a date I would pay.

I opened the unpaid dispute. I suspect SST is going to get this. I'll give him until tomorrow to respond.

Good grief. You busted the guy's balls for not paying immediately during a major holiday week?

I've had PayPal payments take over a week to clear.

Take a chill-pill and calm down a bit.

Also, you might want to review EBay policies regarding payment of auctioned items.

Gavin, wow, pleasant as usual. :)

The auction ended on June 26th, well before the holiday week (which there was no such thing, BTW....there was a holi-DAY...one day). Regardless, I sent an invoice immediately and followed up with an email 3 days later. He communicated at that time that he would pay after the 4th, and when I tried to press for a specific date he went dark; sure, I recognize he might have a good excuse for that so I gave some extra time. He was communicating and then stopped. My last communication to him was to validate that I expected payment on the 6th (10+ days after auction close) or communicate otherwise. That was 11 days ago that he went dark.

I think I have given him all the courtesy expected, and then some. When someone buys something they should pay timely or make some arrangement otherwise...he has done neither...not specifically. His last communication before going dark was "pay you after the 6th"...which simply isn't good enough now that the 9th, another business day, has come and gone and no further comm or payment from him.

EBay seems to have no specific policy but does allow for an unpaid item dispute to be opened as soon as 7 days after auction close. Clearly that indicates to most that they expect payments to no take longer than 7 days on average, without some prior arrangement with the seller.

Sure, maybe something happened and the guy has had issue the past few days. But as I said, he won the auction on the 26th. Prompt, expected, customary payment would have been on the 27th, 28th, 29th (all business days), or the 2nd, 3rd, 5th, or 6th...again, all business days. I also gave the guy the 9th (today)...another business day. And, the guy told me on the 30th that we would pay the 6th.

I suspect he is a deadbeat or stalling. He won another auction on the June 22nd (4 days earlier) and seems to have paid for that auction in a timely manner, getting positive feedback on June 30th. So he gets one auction 4 days earlier and has feedback by the 30th; less than 8 days between close and feedback. He wins my auction on the 26th and stalls on the payment. Almost 14 days later and I am still holding my hat over my arse. The only difference is the amounts of the auction ($40 vs over $200).

It seems to me this guy is stalling because he doesn't have the money. If you don't have the money to pay promptly, don't bid. I'm not a lending agency.

Don't forget the fact that this buyer is incredibly irresponsible. If he knew he couldn't pay on time (or at all)...he should have never bid. Bottom line.
